Spousal Maintenance

Spousal maintenance is financial support paid by one party to a former spouse or de facto partner following separation. It is intended to assist a person who cannot adequately support themselves, taking into account their income, expenses, health, age and capacity to work. At Gramelis Attorneys Family Lawyers, we advise and represent clients in all aspects of spousal maintenance matters, from initial advice through to negotiation and Court proceedings. With offices in Sydney CBD, Bankstown, Bondi Junction and Double Bay, we act for clients throughout Sydney and across Australia.

Unlike child support, spousal maintenance is not automatic. It depends on whether one party has a demonstrated need for financial assistance and whether the other party has the capacity to pay. The Federal Circuit and Family Court of Australia considers a range of factors, including the financial resources of each party, their standard of living during the relationship, caring responsibilities for children and any barriers to employment or financial independence.

Speak with an Experienced Spousal Maintenance Lawyer

Spousal maintenance can be sought on an interim (urgent) or ongoing basis, and in some cases it may be resolved by agreement through negotiated settlements or Consent Orders. In other situations, disputes arise where one party seeks financial support and the other disputes liability or ability to pay. We provide clear, practical advice on entitlement, quantum and likely outcomes based on current case law and judicial approach in family law matters.

At Gramelis Attorneys Family Expert our team of expert family lawyers regularly assist clients in negotiating spousal maintenance agreements, including where it forms part of broader property settlement negotiations. Where agreement cannot be reached, we act in contested proceedings before the Federal Circuit and Family Court of Australia, including urgent applications where immediate financial support is required following separation.

We also advise on the interaction between spousal maintenance and other financial arrangements, including property settlements, income sources, superannuation and Binding Financial Agreements. Our focus is on achieving fair, commercially sensible outcomes that reflect both parties’ financial circumstances while avoiding unnecessary conflict where possible.

Whether you are seeking spousal maintenance, responding to a claim or negotiating a financial settlement after separation, our experienced family lawyers can assist. Gramelis Attorneys Family Lawyers provides strategic advice and representation across Sydney and Australia, helping clients secure clear and workable financial outcomes following separation.
